It is true that immigration is not at all reason for unemployment. When unemployment increases that will decrease immigration to some extent. We could see that in h1b numbers and also illegal immigration. But future immigration will depend on how fast jobs are created when recovery starts.

Sorry to hijack your thread but I didnt want to start multiple threads on the same issue, along similar lines where can I find the actual law on H1B portability on I 140.
I have a offer but the immigration dept of the company says it cannot be done so I need to send them some documentation.

I just noticed that the I-140 my lawyer submitted 3 months ago to Nebraska has a typo in my DOB (21/07/2978 instead of 21/07/1978). Yes its a thousand years out! A copy of my latest I-94 and visa both showing my correct DOB were also submitted with the I-140.
Do any of you guys think I'll have the I-140 rejected, recieve an RFE, or will the Nebraska officer just use common sense and amend it himself? What do you reccomend I do if anything?
Since it is 140, your attorney or you company HR can call up and get this corrected, They will give you a service number. Also they will ask for an email address after 45 days you will get an email that it will be corrected when the file is being reviewed by an officer.

uscis sent incorrect alien registration # with my name to fbi for name check which ended up in an error . now after waiting for 2 years and 4 months uscis tells me that they are going to assign me a new alien # and send name check all over again. i am stuck please help..what options do i have to expedite this as it was uscis error.

This is a very big hell hole for people when they apply for 485.
90% people who apply for 485 are lucky to not face this.
There are just so many issues we face in our immigration process and cause us pain. Our efforts in the upcoming immigration debate will help this issue. There are provisions like doing the entire 485 processing within 6 months we need to protect. Please join us and support us so that we can all get rid of our immigration sufferings.

My mother scheduled a trip to USA on May 1st. I am concerned about her passport. Her old passport got wet on the borders of the first two and last two pages. VISA was stamped in the old passport which seems to be safe. I do not see any wet appearance on the borders of the VISA page. The old wet passport expired anyway. And she got new one. Will it be safe to travel with these two passport having wet old passport containing VISA stamp? Thanks.

Hi All,
I am here in US on a H1B and my wife is on a H4. She recently got admission to a graduate school and has to start next week. I am worried that if I get her COS for the next semester (this is a 1 year program), then woud she be eligible to get her OPT at the end of the program? She would have been on a F1 for less than a year, but would have completed the Master's program.
I tried to get more information, but what I saw was that the OPT eligiblility requirement is atleast 1 full academic year on F1. Is this correct?
Help is greatly appreciated.

My Labor PD is Jan 2003, was approved on Sept 25th. Got it last week. It is very random process I guess. Can't tell how long you have to wait knowing so many people behind us got their approvals before us. Any inquiry didn't work. I just gave up and waited.

My wife and I are scheduled to go for fingerprinting this month. We have a year old son and obviously we are planning to take him with us as well. Do I need to take any form of ID / birth certificate of my son (obviously he is not to be fingerprinted) but not sure what the rules are with respect to carrying infants for the interview. Anyone who has fingerprinted in a similar situation?

Thanks a lot Dom, it took some time for me to find transparent layered maps of water to work with. Initially this was drawn with the orange falling down, but an even splash wasn't what i had in mind. So I had random splash, mostly one directional and then spinned the image to have gravity work as well-once again thanks

I mailed my first EAD application in the last week of Dec/09.
Never thought it would take so long for receipting, and worried something wrong in my application..

but if i wait until my PD is current, then i contact congressmen, by the time they act on it, pd may go out of current. So just looking to get it out of this loop before my pd is current, so that my file will be ready to process.

If your job location has changed from State 'S1' to State 'S2', your labor petition filed from Company 'A' is invalid. You cannot modify your 140 in the sense of changing job location from one state to another. Since your 140 is pending for a good period of time, here is what you can do :-
i) Get it converted to premium as suggested above and you'll know whether it is approved or not in 15 days.
If it is approved, you can file 485 based on it but you may have issues in the future ( possible but unknown if it will be caught at 485 stage )
If it is denied, you are in a soup as without an approved 140, you cannot port your PD.
Whatever you do, dont move onto EAD and work on EAD until your 140 is approved.

This is not the fence bill. This is the DHS appropriations bill in which 1.2 billion dollar is allocated for fence building. Anyways. it doesn't matter if the fence bill is signed or not. It's not gonna make any difference to us so why worry about it.

Targeted site visits. These visits take place where fraud is suspected, and consist of a visit to ask questions. Advance notice, including notice to counsel, is supposed to be provided.
Administrative site visits. These relate to religious worker and H-1B petitions (http://www.geelaw.com/lawyer-attorney-1054805.html). They generally are conducted by contractors who know nothing of immigration law. Religious worker visits are performed under the regulations for that category. For H-1B site visits, the contractors have been equipped with a set of specific questions, and all employers/beneficiaries should be asked pretty much the same questions, primarily reaching the issues of whether there's really an employer there, whether the employer knows it filed the petition, and whether the beneficiary is doing the work and receiving the wage indicated on the petition.
